Flushing Mom Gave Birth To Twins That Weren't Hers, Lawsuit Says

FLUSHING, QUEENS — A Flushing couple is suing a fertility clinic after a woman gave birth to twins that DNA testing showed weren’t hers.

The mother, who is Asian, gave birth to two boys who didn’t appear to be Asian and who genetically matched two other couples who’d gone to the clinic, according to a lawsuit filed last week in the Eastern District of New York.

The couple has accused the Los Angeles-based CHA Fertility Center of medical malpractice, negligence and inflicting physical and emotional harm, PIX11 reported.

“Plaintiffs were shocked to see that the babies they were told were formed using both of their genetic material did not appear to be,” the lawsuit reads.

CHA Fertility did not immediately respond to a request for comment.

The couple, identified only as A.P. and Y.Z., had to give up custody of the newborns, according to the Washington Post. They had paid the clinic more than $100,000 to conceive a child through in vitro fertilization, or IVF.

The couple says they don’t know what happened to the two embryos that were supposed to be transferred to A.P., according to PIX11.
