A judge has dismissed a case against Taylor Swift, remarking the phrase "haters gonna hate" is "too banal" to copyright.
Sean Hall and Nathan Butler sued the pop star last year, and said her hit single Shake It Off stole from their composition, Playas Gon’ Play.
Their chorus goes: "playas, they gonna play, and haters, they gonna hate".
This is similar to the chorus of the song "Shake It Off."
However, Judge Michael W Fitzgerald ruled in Swift’s favour, and wrote: "The lynchpin of this entire case is thus whether or not the lyrics ‘Playas, they gonna play, and haters, they gonna hate’ are eligible for protection.
"In the early 2000s, popular culture was adequately suffused with the concepts of players and haters to render the phrases ‘playas… gonna play’ or ‘haters… gonna hate’, standing on their own, no more creative than ‘runners gonna run’; ‘drummers gonna drum’; or ‘swimmers gonna swim.’
He argued that the judge should have called in an expert to rule on the originality of the lyrics instead of interpreting them himself.
"He cannot make himself an expert in the music industry," he said. "I’m sorry. it’s actually embarrassing."

The stunned couple who took in Nikolas Cruz after the death of his mother has spoken for the first time about the troubled teenager suspected of killing 17 students and staff at his former high school in Florida on Valentine’s Day.
Kimberly and James Snead described the 19 year-old as immature, quirky and depressed – but pleasant and growing happier and giving no clues of the horror he was about inflict as he plotted the massacre under their roof.
“We had this monster living under our roof and we didn’t know,” Kimberly Snead told the South Florida Sun Sentinel. “We didn’t see this side of him.”
“Everything everybody seems to know, we didn’t know,” James Snead said. “It’s as simple as that.”

The Sneads agreed to take in Cruz after their son had asked whether his friend could move into their home after the death of his adoptive mother left him an orphan last November.
“I told him there’d be rules and he followed every rule to the T,” said Mr Snead, 48, an Army veteran who was happy for the teenager to have guns at home as long as they remained in a gun safe.
They told Cruz he needed to ask permission to take out the guns. He had asked only twice since November. They said “yes” once and “no” once.
The night before the shooting was uneventful and he went to bed around 8pm after eating dinner, the couple said.

On Wednesday morning, Cruz told them he didn’t need a ride to school: “It’s Valentine’s Day and I don’t go to school on Valentine’s Day,” he said.
Mrs Snead last saw him around 10am before she left to run errands. He told her he was going fishing and was gone when she returned. The nurse went to sleep ahead of a nightshift.
Around 2.30pm on Wednesday, their son called his father sounding panic-stricken. He assured them he was safe but had heard shots fired on campus and had helped classmates flee by climbing a fence.

He told his son to walk to a nearby store and he’d come and collect him.
As he drove there, a SWAT commander called his mobile phone and asked where his "son" Nik was. He explained he wasn’t his son and he had no idea where he was.
After putting the phone down, he started to put together the pieces and called the officer back and, worried for his wife, he told him: “I need a police presence at my house. Go make sure my wife is OK."
A drug used to execute American prisoners and to put animals to sleep has been discovered in canned dog food in the US, triggering an emergency recall.
The Food and Drug Administration said it found low levels of pentobarbital in tins of Gravy Train dog food produced by JM Smucker.
The drug is most commonly used by vets as a sedative or anaesthetic and to euthanise pets.
At high doses in humans it cause respiratory arrest and has been used to carry out executions often as the first step – inducing unconsciousness – in a three-drug protocol.
It was one of the drugs used by Marilyn Monroe when she took her own life.

The recall followed an investigation by WJLA, a TV station in Washington, which found pentobarbital in almost two thirds of cans it tested.
The FDA said: "Pets that eat pet food containing pentobarbital can experience drowsiness, dizziness, excitement, loss of balance, nausea, nystagmus (eyes moving back and forth in a jerky manner) and inability to stand. Consuming high levels of pentobarbital can cause coma and death.”
It concluded that the small amounts detected posed little risk to dogs.
"However, any detection of pentobarbital in pet food is a violation of the Federal Food, Drug, and Cosmetic Act—simply put, pentobarbital should not be in pet food," it said.
Smucker said it had identified the problem at a single supplier, from a single, minor ingredient, used at one manufacturing facility.
“We take this very seriously and are extremely disappointed that pentobarbital was introduced to our supply chain. We will continue to work closely with our suppliers and veterinarians to ensure the ingredients used in our products meet or exceed regulatory safety standards and our high-quality standards,” said Barry Dunaway, president of the companies pet foods division.
“Above all, we are a company that loves pets and understand the responsibility we have in providing high quality food for the pets our consumers love.”
There are growing indications that international sanctions are taking a toll in North Korea, with even paper for the country’s main publication running short.
In additional to the problems facing the Rodong Sinmun, the newspaper that serves as the mouthpiece of the regime, Pyongyang’s hard currency reserves are expected to dry up by October, the trade deficit is continuing to widen, and food and fuel are in increasingly short supply.
The head of South Korea’s parliamentary intelligence committee briefed politicians this week on the state of the North’s finances, which have been seriously affected by the freezing of the regime’s accounts overseas and a ban on virtually all exports.
Kang Seok-ho, a politician of the opposition Liberty Korea Party, later told Yonhap news that it is clear that the sanctions are having an effect and that Pyongyang’s new-found desire for détente with the South is a direct result of the hardships it faces.
Reports from the North are already describing the shortages facing ordinary people as the new “arduous march”, a reference to the famine in the mid-1990s that claimed as many as 3.5 million lives.

The Chosun Ilbo newspaper has reported that two of the main energy plants that provide power to Pyongyang have been shut down for 10 days so far this year, resulting in shortages and blackouts in parts of the capital.
Coal mines are unable to operate at full capacity due to the shortage of fuel, while any coal that is mined cannot be transported. Imports of coke from China have also been halted, meaning that even the elite of North Korean society are having to put up with no power or heating.
Food rations have been cut by half and there is virtually no white rice available and the price of cooking oil has also soared.
The print run of the Rodong Sinmun has been cut from 600,000 copies a day to just 200,000 newspapers and home deliveries have been cancelled, the Chosun Ilbo reported.

The recent visit to South Korea by a delegation from Pyongyang to the opening of the Winter Olympic Games also inadvertently revealed that North Korean has been cut off from the global satellite communications network for air traffic controllers after it defaulted on payments eight months ago.
Air traffic controllers at Pyongyang’s Sunan International Airport were forced to use a conventional telephone line to inform their counterparts at Incheon International Airport that the flight had departed.
Still resisting the international community’s pressure to get rid of its nuclear arsenal and intercontinental ballistic missiles, however, North Korea is going to ever-greater lengths to obtain the money and materiel that it needs to survive.

Chinese and Japanese authorities are cracking down on reports of vessels carrying out illegal ship-to-ship transfers of goods and fuel in the East China Sea, while defectors in South Korea are suddenly receiving messages to send money to the North if they want their relatives they left behind to remain safe.
One defector has said a video was posted on a North Korean propaganda website criticising his escape and threatening his family. In a subsequent phone call, he was told his family was “begging” him to send them 10 million won (£6,650). Others have used middlemen in China to buy rice and send to their relatives in the North, although it is assumed that the money or food does not reach its intended destination.

Elle informe patients et professionnels de santé de la conduite à tenir.“Défaut d’étanchéité du flacon” et risque de surdosage“Ce[s] rappel[s] [sont] effectué[s] par précaution suite à la détection de plusieurs flacons contenant une concentration anormalement élevée de la substance active due à un défaut d’étanchéité du flacon, entraînant un risque de surdosage pour le patient en desmopressine”, indique l’agence. Tous les lots sont concernés. Ces médicaments seront indisponibles “au moins jusqu’en 2021”. En ce qui concerne OCTIM, “cette indisponibilité est mondiale”, précise-t-elle.Les premiers signes d’un surdosage en desmopressine sont principalement une diminution de la quantité d’urine, des maux de tête, des nausées et vomissements, une prise de poids, des évanouissements, des douleurs abdominales, des crampes musculaires, des sensations de vertige, et une confusion. Avec OCTIM, il est recommandé “d’interrompre les prises de liquides (eau, soupe, bouillon, yaourt liquide, lait, toutes boissons…) ainsi que le traitement et obtenir un avis médical dans les meilleurs délais”. Avec Minirin Spray, les recommandations sont de diminuer voire suspendre quelques heures le traitement, et réduire les prises de liquides. “En aucun cas vous ne devez arrêter de manière prolongée votre traitement sans avis médical”, avertit l’ANSM.Les recommandations de l’ANSM pour les patientsD’autres recommandations ont été mises à destination des professionnels de santé et des patients, “pour répondre [à leurs] besoins tout en assurant leur sécurité”, et “éviter toute interruption de traitement”.
Pour les patients sous Minirin Spray, “l’alternative à privilégier est la spécialité Minirinmelt en lyophilisat oral (desmopressine)”. Ils doivent pour cela contacter leur endocrinologue ou leur médecin généraliste. “Si nécessaire, votre pharmacien pourra vous délivrer la spécialité Minirinmelt 60 microgrammes, et en informera votre médecin. La posologie de Minirinmelt sera adaptée en fonction de votre posologie habituelle de Minirin Spray. L’administration de Minirinmelt est différente, il s’agit d’un lyophilisat oral, c’est à dire un comprimé qui ne doit pas être avalé mais placé sous la langue jusqu’à sa dissolution sans apport d’eau”, prévient l’ANSM.
Pour les patients sous OCTIM, “l’ANSM s’assure auprès du laboratoire de la mise à disposition suffisante des alternatives existantes, notamment Minirin injectable”. Les patients sont invités à contacter leur médecin traitant ou en priorité le médecin spécialisé de leur centre habituel.

Eventually he was promoted to show producer. From that point, he became an overnight and fill-in host on WFAN and was part of the original schedule on CBS SPORTS RADIO, doing a Saturday morning show with Maggie Gray called Moose & Maggie. In March of 2008, Malusis was hired as a personality for SNY, where he worked as a debater on SportsNite and appeared on DNL, The Wheelhouse, LoudMouths, and BNNY.
Matt Hardy is currently testing out his brand new “Woken” gimmick in WWE. So far, the character has been extremely similar to the “Broken” character that he previously portrayed. Several elements of the old character have shown up again in Matt’s new “Woken” gimmick, and he has now ditched his old Hardy Boyz entrance theme music. During a recent Madison Square Garden live event, Hardy came down to the ring to face Bray Wyatt with the ‘Moonlight Sonata’ theme that he used as “Broken” Matt Hardy in Impact Wrestling playing on his way down. Matt Hardy has yet to debut his new entrance theme on WWE television, but he will likely be doing so soon.

On last week’s episode of Smackdown, Dolph Ziggler laid down the United States Championship in the ring before exiting the building without much explanation. It was later confirmed that Ziggler will be taking some time off. As a result, Daniel Bryan made the announcement on Smackdown this week that Ziggler has relinquished the title. Bryan then confirmed that there will be a tournament to crown the next United States Champion. Very few details about the tournament were shared, but Bobby Roode defeated Baron Corbin to qualify for the second round, and Jinder Mahal defeated “The Perfect 10” Tye Dillinger in a first round tournament match as well.
The Royal Rumble is beginning to take shape as WWE heads into the new year. “The Drifter” Elias officially declared himself the first entrant in the Royal Rumble match a few weeks ago. Since then, two more wrestlers have announced their intentions to enter the match on this past Tuesday’s Smackdown show. Randy Orton promised to enter the match, then Shinsuke Nakamura announced that he would be joining the Royal Rumble match not long after that. Orton and Nakamura are the first two Smackdown talents to announced their participation in the match. The Royal Rumble will be taking place at the Wells Fargo Center in Philadelphia, Pennsylvania on January 28th, 2018.
Former WWE Universal Champion and United States Champion Kevin Owens recently spoke to MLive.com to talk about a variety of professional wrestling topics. “KO” discussed not caring about being booed or cheered by crowds, wanting to wrestle Shawn Michaels, and if he’d let his kids wrestle. The highlights can be seen below:
Not caring if he is booed or cheered by a crowd:
“I just try to listen to strong reaction. To me the best reaction is a mix of both boos and cheers. John Cena and Roman Reigns get insane reactions where half the crowd loves them and half the crowd despises them. When you’re in the ring waiting for your opponent, whether it’s John or Roman, you get hit by this crazy noise. It’s people almost competing with each other. The guy who’s booing one of them is trying to be louder than the guy cheering. It makes for a special atmosphere. That’s really what I’m striving for.”
Wishing he could’ve wrestled Shawn Michaels:
“Michaels is the reason I became a wrestler in the first place. I saw him when I was 11. I was a scrawny kid at the time. People thought I was 7 or 8. So to see the smallest guy on the show be the best guy on the show really spoke to me. I said if he can do it, I can do it. Now I get to share different pieces of his wisdom with him when he comes to a show here or there. I try to sit as close to him as I can and listen to him and discuss wrestling, family and life. It’s so great to talk about those things with someone I look up to so much. I can’t even imagine what it would have been like to have been in the ring with him.”
If he’d let his kids become wrestlers:
“I don’t hope for it, but if they want to then they’re more than welcome. I have no preference. I just want them to be happy. I always pursued this dream, but for the first 7 years that I was a wrestler, I worked at a gas station part time. I finished high school, but still needed a job to make money to live on. I was lucky enough to have the boss to give me time off I needed to wrestle. I think you can be happy doing whatever you want in life as long as it fulfills you can you get something out of it.”
